The answer isn’t always straightforward, but it is essential to understand. Here are 3 reasons why you may need a witness during a notarization:


✅ 1. Document Requirements

Some documents—like wills, deeds, or powers of attorney—may legally require witnesses in addition to your notarization. This is often stated in the document itself or governed by your state’s laws.

✅ 2. Signer or Company Requests

Even if a document doesn't require it by law, a signer, title company, or law firm may still require a witness. As the notary, it’s your job to follow these instructions—but also to ensure the witness meets any legal qualifications.

✅ 3. State-Specific Rules

Some states require a witness for particular documents like real estate transfers or living wills. Knowing your state-specific notary laws ensures you stay compliant and avoid trouble down the road.
